These terms apply to every booking, stay and visit at Shady Acres Caravan Park, M8 / 9435 National Highway, Warrenheip VIC 3352 (“Shady Acres”, “we”, “us”). By making a booking, checking in, or entering the property, you and everyone in your party agree to these terms.
1. Bookings & payment
- Bookings are subject to availability and to these terms.
- Rates are in Australian Dollars (AUD) and include GST unless stated otherwise.
- Rates are per site or cabin, based on the number of adults and children advised at the time of booking. Additional guests must be declared and may attract additional fees.
- A booking is only confirmed once we have issued a booking confirmation by email or in writing.
- Payment may be made at the time of booking or at reception on arrival. We accept EFTPOS, major credit cards and direct deposit. A surcharge may apply to some card types.
- A valid credit card must be provided at check-in for every stay (regardless of how you plan to pay) as security for any charges — including unpaid accommodation, damage, excessive cleaning, storage fees or missing items. By providing your card, you authorise us to charge it for any such amounts owing.
- The lead guest must be 18 years or over and is responsible for the booking, the behaviour of all guests and visitors on the site, and any charges owing.
2. Cancellations, changes & no-shows
Governed by our Cancellation Policy above (Policy 01). By making a booking, you accept that policy in full.
3. Check-in & check-out
- Check-in is from 2:00pm. Check-out is by 10:00am.
- Late check-in is available with prior notice — please phone ahead and we'll leave keys in the after-hours box.
- Late check-out is subject to availability. Unapproved late departures may attract a fee of $25 per hour past 10:00am.
- Photo ID and the credit card used for booking may be requested at check-in.
4. Guests, visitors & occupancy
- Only guests named on the booking may stay overnight. Sites and cabins have a maximum occupancy which must not be exceeded (including infants).
- Day visitors are welcome between 8am and 8pm and must register at reception. Visitors are the responsibility of the host guest.
- We reserve the right to refuse entry or ask guests or visitors to leave the property at any time, without refund, if these terms are breached.
5. Behaviour & quiet hours
- Quiet hours are 10:00pm to 7:00am. Please keep noise to a minimum, including generators, radios, TVs and vehicles.
- Anti-social, threatening, discriminatory or unlawful behaviour will not be tolerated. Guests engaging in such behaviour will be asked to leave immediately without refund.
- The lead guest is responsible for the behaviour of everyone in their party, including children and visitors.
6. Children
- Children under 16 must be supervised by a responsible adult at all times, including at the swimming pool, amenities blocks and around vehicle areas.
- The pool is unsupervised. Use is at guests' own risk and only during posted hours.
7. Pets
Pets are welcome subject to our Pet Policy above (Policy 02). By bringing a pet, you accept that policy in full.
8. Smoking, alcohol & drugs
- Shady Acres is a non-smoking property inside all cabins, amenities blocks and enclosed public areas. Smoking (including vaping) is permitted only on your own outdoor site, away from other guests.
- Alcohol may be consumed responsibly at your own site or cabin. Public drunkenness or supplying alcohol to minors is prohibited.
- Illegal drugs are prohibited anywhere on the property and will be reported to Victoria Police.
9. Fires & fire-pit use
- Open fires are permitted only in the communal fire-pit circle and in park-supplied fire rings on eligible sites.
- Fires are prohibited on Total Fire Ban days (as declared by the Country Fire Authority) and during any Fire Danger Period restriction. Guests must monitor CFA advice and follow all directions from park staff.
- Fires must be attended at all times and fully extinguished before you leave your site or go to bed. Wood may be purchased at reception; foraging is not permitted.
- Gas BBQs and camp stoves must be used safely and never inside cabins, tents or annexes.
10. Site care, damage & cleaning
- Please leave your cabin or site in the condition you found it.
- Any damage, breakage or excessive cleaning (including odours, soiling, or damage from pets) will be charged to the credit card on file at cost, plus a reasonable service fee.
- Rubbish must be disposed of in the bins provided. Grey water and chemical waste must go to the dump point only — not to sites, drains or the bushland.
11. Vehicles & parking
- The park speed limit is 10km/h at all times. Children play throughout the park.
- One vehicle per site is included; additional vehicles must be registered at reception and may attract a fee.
- Please park within your allocated site or in visitor parking. Blocking access roads or other sites is not permitted.
12. Amenities & pool
- The seasonal pool is open December to April, weather permitting, during posted hours. Use is at guests' own risk. No glass, no diving, no unsupervised children.
- Wi-Fi (where available) is provided as a courtesy. It is not guaranteed to be uninterrupted or suitable for streaming, work-critical use or large downloads.
13. Personal property & liability
- Guests bring personal property, vehicles, caravans, tents and pets onto the property at their own risk.
- To the maximum extent permitted by law, Shady Acres, its owners, employees and contractors are not liable for any loss, theft, damage, injury or death occurring on the property, except where caused by our negligence or breach of consumer law.
- Nothing in these terms excludes, restricts or modifies the guarantees, rights or remedies you may have under the Australian Consumer Law or other Victorian and Commonwealth legislation which cannot lawfully be excluded.
14. Photography & marketing
We may occasionally take photographs or video of the park for marketing purposes. Every effort is made to avoid capturing identifiable guests. If you appear in an image and would prefer it not be used, please contact us and we'll remove it promptly.
15. Privacy
Personal information collected during booking is handled in accordance with our Privacy Policy below (Policy 05).
16. Force majeure
We are not liable for any failure or delay in providing accommodation caused by events beyond our reasonable control, including bushfire, flood, storm, power failure, pandemic, government direction or industrial action. Where possible, we will offer an alternative date or refund of amounts paid for the affected nights.
17. If you don't pay, or leave things behind
We're a small family-run park, so we rely on prompt payment. This section explains what happens if payment falls through, or if property is left on site.
If payment isn't made
- Full payment is due at check-in unless we've agreed otherwise in writing. We may refuse or end your stay immediately if payment isn't made.
- If you leave without paying, you authorise us to charge the credit card on your booking for the full amount owing, plus any reasonable costs of recovery (bank fees, collection agency fees, or legal costs).
- Balances left unpaid for more than 14 days may be referred to a debt collection agency, which can affect your credit rating.
If you leave things behind
- Shady Acres Caravan Park reserves the right to remove any abandoned caravan, vehicle, tent, cabin contents or personal property from your site or cabin where a stay has ended, has not been paid for, or the property has otherwise been left behind — so we can return the site or cabin to service for other guests.
- Any items we remove will be dealt with under the Uncollected Goods Act 1995 (Vic). We'll take reasonable care of them while they're in our custody, but we're not liable for loss or damage that occurs to abandoned property.
- A daily storage fee at the applicable site or cabin rate continues to accrue from the check-out date until the items are collected.
- Vehicles or caravans left past check-out may be moved within the park or towed off-site at the owner's cost.
- Before we sell or dispose of any items, we'll try to reach you using the phone, email and address on your booking — please keep those details current.
How money is applied
Any funds we recover (from a card charge or a sale of goods) are applied in this order: (1) unpaid accommodation, (2) storage fees, (3) removal or legal costs, and (4) anything left over is held for you and paid back on request with proof of identity.
Nothing in this clause limits any other right we have under law.
18. Changes to these terms
We may update these terms from time to time. The version in effect at the time of booking will apply to your stay.
19. Governing law
These terms are governed by the laws of the State of Victoria, Australia. Any dispute will be dealt with by the courts of Victoria.
